1. Agreement to Terms

By accessing or using the website, services, or requesting a quote from DMS Home Improvement ("Company," "we," "our," or "us"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, please do not use our website or services.

2. Services Description

DMS Home Improvement is a family-owned, licensed and insured General Contractor providing residential remodeling and construction services throughout New Hampshire (Hollis, Hudson, Pelham, Salem, Windham, Londonderry, Derry) and Massachusetts (Middlesex and Essex County). Our services include:

- Kitchen remodeling
- Bathroom remodeling
- Carpentry
- Tile installation

3. Service Agreement

3.1 Quotes and Estimates

Estimates provided through our website, phone, or in-person consultations are preliminary and based on the information available at the time. A final, binding price is established in a written contract signed by both parties once the full scope of work, materials, and selections have been defined. Any changes requested after signing will be handled through a written change order, including any adjustment to price or schedule, signed by both parties before the additional work proceeds.

3.2 Scheduling

Project start and completion dates depend on factors including permit approval (where applicable), material lead times, weather, and crew availability. We will communicate any schedule changes as promptly as possible and work to minimize disruption to your home.

3.3 Property Access

By engaging our services, you grant our team reasonable access to the project area during agreed working hours. You are responsible for clearing the work area of personal belongings, securing pets and valuables, and ensuring access to necessary utilities (water, electricity) where work will be performed.

4. Payment Terms

- A signing deposit may be required to schedule the project and, where applicable, to order materials

- For larger projects, progress payments may be tied to defined milestones set out in the written contract

- Final balance is due upon substantial completion and a walkthrough with the homeowner

- We accept cash, check, ACH transfer, and credit card; specific accepted methods will be confirmed in your contract

- Late payments may be subject to interest or late fees as permitted under New Hampshire and Massachusetts law

- Returned/bounced checks are subject to a $35 processing fee

5. Cancellation Policy

Consumers in New Hampshire and Massachusetts may have a statutory right to cancel certain home improvement contracts within three (3) business days of signing, without penalty, as provided under applicable state law. This right applies primarily to contracts signed at a location other than our regular place of business (for example, in your home).

- Cancellations within the applicable statutory rescission period: full refund of any deposit paid

- Cancellations after the rescission period but before materials have been ordered: refund of deposit minus the value of any design, planning, or engineering work already performed

- Cancellations after materials have been ordered or work has begun: the customer is responsible for the cost of materials ordered, labor performed, and any applicable restocking fees

Nothing in this section limits any cancellation or rescission right you may have under New Hampshire or Massachusetts consumer protection law.

6. Warranty and Liability

6.1 Workmanship Warranty

We warrant our workmanship for one (1) year from the date of substantial completion. Defects in workmanship reported to us in writing during this period will be corrected at no charge. Warranties on materials, fixtures, and appliances are provided by their respective manufacturers and are subject to the manufacturer's own terms and conditions.

6.2 Customer-Supplied Materials

When a customer chooses to supply their own materials or fixtures, DMS Home Improvement is not responsible for defects, missing parts, or installation issues arising from the condition or suitability of the customer-supplied item. Additional labor required to correct such issues, or to install replacement materials, will be billed at our standard rates.

6.3 Limitation of Liability

To the fullest extent permitted by law, DMS Home Improvement's total liability arising out of or related to our services is limited to the amount paid under the applicable contract. We are not liable for indirect, incidental, special, or consequential damages arising from our services, except where such limitation is not permitted by New Hampshire or Massachusetts law.

7. Property and Site Conditions

- We take reasonable measures to protect floors, finishes, and adjacent areas of your home through site protection and daily cleanup

- Minor cosmetic touch-ups (such as small paint blemishes or construction dust) are a normal part of the renovation process; any remaining items are addressed on the final punch list

- Please inform us in advance of any known pre-existing structural, electrical, or plumbing issues, as well as any hazardous materials (such as asbestos or lead paint) that may be present, particularly in homes built before 1978

- DMS Home Improvement carries general liability insurance and, where required, workers' compensation coverage

8. Intellectual Property

All content on this website, including text, images, logos, photos of completed projects, and design elements, is the property of DMS Home Improvement or its licensors and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or use this content for commercial purposes without our prior written permission.

9. Customer Responsibilities

As a customer, you agree to:

- Provide accurate information about your property when requesting a quote

- Disclose any known HOA rules, historic district restrictions, or permitting requirements applicable to your property

- Keep the work area reasonably clear and accessible during scheduled work hours

- Notify us promptly of any changes affecting the scope of work

- Ensure that any pets are secured away from the work area for their safety and ours

10. Force Majeure

DMS Home Improvement is not liable for delays or failure to perform obligations due to circumstances beyond our reasonable control, including but not limited to severe weather, natural disasters, material or supply shortages, labor shortages, power outages, pandemics, or government restrictions or permitting delays.

11. Dispute Resolution

We aim to resolve any disagreements through direct, good-faith communication. If a dispute arising from these Terms or from a service contract cannot be resolved informally, both parties agree to attempt mediation before pursuing formal legal action, except that either party may pursue individual claims in small claims court where applicable.

12. Governing Law

These Terms, and any services provided by DMS Home Improvement, are governed by the laws of the State of New Hampshire, without regard to its conflict of law principles, except that services performed on property located in Massachusetts remain subject to applicable Massachusetts home improvement contractor laws and regulations.

13. Website Use

Our website is provided for informational purposes to help you learn about our services and request a quote. We do not guarantee that the website will be uninterrupted, error-free, or fully up to date at all times, including project photos, pricing ranges, or service area information.

14. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes take effect immediately upon posting to our website. Your continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.

15. SMS, Phone, and Email Communications

By submitting your contact information through our website, phone, or forms, you consent to be contacted by DMS Home Improvement via phone call, text message (SMS), or email regarding your inquiry, quote requests, appointment reminders, project updates, and related customer support.
